By accessing or using the Platform, you agree to comply with and be bound by these terms and conditions. 1. Eligibility

1.2. By using the Platform, you represent and warrant that you meet the eligibility requirements set forth in this section.

2. Registration and Account

2.1. In order to access certain features of the Platform, you may be required to register for an account. When registering, you agree to provide accurate, current, and complete information about yourself as prompted by the registration form.

2.2. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account or password.

3. User Conduct

3.1. You agree to use the Platform only for lawful purposes and in accordance with these terms and conditions.

3.2. You agree not to engage in any conduct that could damage, disable, overburden, or impair the Platform or interfere with any other party’s use of the Platform.

3.3. You agree not to use the Platform to:

(a) Engage in any fraudulent or unlawful activity;

(b) Violate any applicable laws or regulations;

(c) Transmit any viruses, worms, defects, or other items of a destructive nature;

(d) Collect or store personal data about other users without their express consent;

(e) Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.

4. Content

4.1. You are solely responsible for any content that you upload, post, transmit, or otherwise make available on the Platform.

4.2. By submitting content to the Platform, you grant FlapAfrica/Flap and its affiliates a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

5. Privacy

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these terms and conditions by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

6. Intellectual Property

6.1. The Platform and its original content, features, and functionality are owned by FlapAfrica/Flap and its affiliates and are protected by the copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

6.2. You agree not to modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Platform, except as necessary for your own personal, non-commercial use.

7. Termination

7.1. We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these terms and conditions.

7.2. Upon termination, your right to use the Platform will immediately cease, and you must cease all use of the Platform.

8. Disclaimer of Warranties

8.1. The Platform is provided “as is” and “as available” without any warranties of any kind, whether express or implied.

8.2. We do not warrant that the Platform will be uninterrupted or error-free, that defects will be corrected, or that the Platform is free of viruses or other harmful components.

9. Limitation of Liability

In no event shall Flap nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from

(a) Your use or inability to use the Platform;

(b) Any unauthorized access to or use of our servers and/or any personal information stored therein;

(c) Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Platform by any third party;

(d) Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Platform.:

10. Changes to Terms

We may, at any time, modify the terms and conditions of our relationship but we will not do this without first informing you of such modification. All updates will be detailed on our website and our app. You will be able to access the latest version of our terms at any given time.
